The amparo remedies, in this way, allow safeguard the constitutional rights of individuals<\/strong>. They also protect the principles of Constitution<\/strong> in the event of possible violations by judicial organisms or even contradictions generated by certain norms.<\/p>\n

Suppose a footballer is sanctioned by the Disciplinary Tribunal<\/strong> of the tournament that disputes after being confirmed, through a drug test<\/strong>, who played a game under the influence of a drug. The athlete, faced with this situation, presents an appeal for protection in the Justice<\/strong> alleging that they are restricting his right to work and highlighting that he used a social drug that does not provide sports benefits. The Supreme Court<\/strong>, in this way, gives rise to protection and obliges the Disciplinary Tribunal<\/strong> to allow the player to continue in activity.<\/p>\n

As with any technical term, the amparo remedy receives different names, depending on the Spanish-speaking country. In Colombia, for example, it is known as action of guardianship<\/strong><\/em>, while in Venezuela, Peru, Bolivia and Ecuador it is called Amparo action<\/em>. This has not always been the case, since in Bolivia it used to be called appeal<\/em>, but the name was replaced over time.<\/p>\n

\"Protection\"According to the legal perspective, scholars have different opinions about this concept. For example, there are those who reject the idea that it is considered a remedy, since in such a case it should be raised within a process, instead of seeking to protect the rights of individuals, as is the case with the appeal for amparo. If it were a resource, then it would be used to correct certain procedures<\/strong> inadequate or to correctly interpret the regulations in force in the context of a trial.<\/p>\n

Finally, it should be noted that Protection<\/strong> is a name of woman<\/strong> that is used in Spain<\/strong> and in several Latin American countries. Chilean actress Amparo Noguera<\/strong>, Spanish politics Amparo Valcarce<\/strong> and the Colombian writer Amparo Osorio<\/strong> are three outstanding examples.<\/p>\n

The etymology of this proper name is not a mystery, since its meaning is the same as the term protection<\/em> when used as a common noun, that is, \u00abprotection<\/strong>\u00ab. This brings us to one of the meanings given by the dictionary of the Royal Spanish Academy: \"person or thing that provides protection to another.\"<\/p>\n

It is interesting to think that the word protection<\/em> It does not only refer to the protection that someone or a law can provide us, but also to the same people who provide it to us. In this way, we can use it as a synonym for \u00abrefuge<\/strong>\u00ab: \u00abMy friends have been my protection in these difficult times\u00bb<\/em> or \u00abIn my childhood, books were my protection against the violence that was lived in my house\u00bb<\/em>.<\/p>\n<\/div>\n\n\n
